Terms & Agreement

Section 1: Scheduling and Communication
1.1 Creating an Appointment 
Appointment requests for photography and videography may be initiated via email, phone, or text message. New clients are encouraged to use the Contact Portal on our website. An appointment is officially considered “Booked” only when the following criteria are met: the full property address has been provided, both parties have confirmed the specific date and time in writing, and a clear access method has been established. No deposit is required prior to the appointment.

1.2 Last-Minute Requests 
While we aim to accommodate all clients, requests made within 24 hours of the desired shoot time are not guaranteed and are subject to schedule availability. Such requests will incur a $50 Short-Notice Booking Fee.

1.3 Order Accuracy 
Because our service packages are based on photo count rather than property square footage, the client is responsible for selecting the package that best represents the property. If, upon arrival, the photographer determines additional photos are required to adequately capture the home, we will consult with the client regarding an upgrade in package price before proceeding.

1.4 Communication Standards 
We strive to respond to all inquiries within 3–8 business hours. Requests received after standard business hours or on weekends will be processed and responded to the following business day.

Section 2: At The Appointment
2.1 Property Readiness 
To ensure the highest quality results, clients are expected to have the property fully cleaned, decluttered, and staged prior to the photographer's arrival. All properties will be shot “As Is.” While Top Frame Media will make a reasonable effort to remove minor litter or stray objects, we are not responsible for staging furniture, making beds, or moving heavy items and vehicles.

2.2 Pet Policy 
For the safety of the photographer and the quality of the images, all pets must be removed from the property or secured in a crate/designated room for the duration of the shoot.

2.3 Right to Declare a Property “Not Shoot Ready” 
Top Frame Media reserves the right to declare an appointment “Not Shoot Ready” if, upon arrival, the property is deemed excessively cluttered, dirty, or presents an unsafe working environment. In such cases, the photographer reserves the right to decline the shoot. The appointment will be canceled and subject to a $50 Cancellation Fee.

2.4 Representation and On-Site Approval 
The client is responsible for the presence of an authorized representative at the shoot to approve the photographer’s artistic interpretation. If a representative is absent, Top Frame Media will use their professional judgment, and the photographer’s interpretation shall be deemed acceptable. Any requests for a re-shoot due to subjective preferences (angles, room choice, etc.) will incur a minimum $100 Revisit Fee.

2.5 Arrival, Delays, and Access 
Top Frame Media provides a grace period for properties that are not quite ready, subject to the photographer’s schedule. However, if a property is deemed "not ready" to the point that it would interfere with the schedule, we reserve the right to declare the shoot incomplete. A $100 Revisit Fee will be required to return. If the property is located more than 60 miles from our office, an additional travel fee may apply to the revisit.

Section 3: After The Appointment
3.1 Post-Processing & Turnaround Times
• Standard Real Estate Photography: 24–48 hours after the conclusion of the appointment.
• Short-Term Rental (STR/Airbnb) Photography: 5 business days.
• Video Products: 4–7 calendar days, depending on the complexity of the edit. 

Top Frame Media reserves the right to extend any delivery deadline by up to 72 hours in the event of rare, unavoidable circumstances.

3.2 Product Delivery & Resolution 
Delivery is fulfilled via a shared link to a cloud-based storage service. Photos are delivered in a high-resolution format optimized for internet use. Higher resolution files suitable for printing are available upon request at no additional charge.

3.3 Storage & Hosting 
All digital products will be hosted in the cloud folder for 6 months. After the 6-month window, Top Frame Media does not guarantee that products will remain available. If a client requests files beyond this window, we will make a reasonable effort to recover them from offline archives at no fee, though recovery is not guaranteed.

Section 4: Cancellation, No-Show, and Inclement Weather
4.1 Cancellation & Rescheduling 
A minimum of 24 hours' notice is required for cancellation or rescheduling. Any shoot cancelled or rescheduled within 24 hours of the appointment is subject to a $50 Cancellation Fee. As a courtesy, the fee for the first occurrence will be waived.

4.2 No-Show & Late Arrival 
If a representative is expected but not present, a 15-minute grace period is provided, after which the photographer will begin the shoot (see Section 2.4). If the photographer cannot access the property and no communication is received within 30 minutes, the shoot will be considered a "No-Show" and billed at the full rate of the scheduled shoot. Top Frame Media reserves the right to review these on a case-by-case basis.
4.3 Inclement Weather Policy In the event of weather preventing photography, we will reschedule at the earliest available time at no cost. At the photographer’s discretion, we may perform a partial shoot of the interior rooms not affected by exterior weather. There is no additional return fee for exteriors that must be rescheduled due to weather.

Section 5: Rights and Usage
5.1 Intellectual Property & Ownership 
All digital products produced by Top Frame Media remain the sole intellectual property of Top Frame Media. We retain the copyright to all works.

5.2 Residential Real Estate Licensing A limited license is granted to the Client (Agent/Broker) for the duration of the listing or until the property is sold/leased. This license is non-transferable; if a new agent takes over the listing, they must acquire a separate license.

5.3 Short-Term Rental (STR) Licensing 
A perpetual license is granted to the Client who purchased the services. This license is tied to the individual or entity that paid for the services. If property management is transferred, the new manager must acquire a new license from Top Frame Media.

5.4 Third-Party Prohibitions 
The licenses granted are for the Client only. Usage by third parties (builders, designers, stagers, etc.) is strictly prohibited without a separate licensing agreement and fee.

5.5 Photographer Portfolio Rights 
Top Frame Media reserves the right to use any digital products for our own portfolio, social media, and self-promotion.

Section 6: Floor Plan Measurements & Expectations
6.1 Purpose and Accuracy 
Floor plans generated via CubiCasa® are provided as a visual aid for display and orientation purposes only. Top Frame Media provides estimated measurements only; these are not guaranteed to be accurate for legal, appraisal, or construction purposes.

6.2 Professional Status 
Top Frame Media and its photographers are not certified appraisers, architects, or surveyors.
6.3 Limitation of Liability 
By default, floor plans are provided without measurements. By using these floor plans, the Client acknowledges that Top Frame Media is not responsible for any discrepancies in square footage or dimensions.

Section 7: Payments
7.1 Payment Methods 
Payments are accepted via Stripe (Credit Cards), PayPal, Venmo, and Zelle.

7.2 Delivery Portal & Invoicing 
Assets are delivered via a Live Delivery Portal. This allows the Client to preview watermarked deliverables prior to payment. The license to use the images (as defined in Section 5) is only activated once the invoice is paid in full, which unlocks the high-resolution assets for download.

7.3 Satisfaction & Revisit Policy 
If unsatisfied, clients should contact us immediately. Revisits may be subject to a fee (see Section 2.5). Top Frame Media reserves the right to decline a full refund once the property visit and media capture have been completed. Partial refunds for incomplete deliveries will be considered on a case-by-case basis.
